New rules 'protect countryside'

Greg Clark: "It's very hard for people to engage with the planning system"

The government says that new planning guidelines for England will protect the countryside, boost jobs and "help build the homes the next generation needs".

Planning Minister Greg Clark told MPs the old, complex system "sorely needed" reform, as it had "ground ever slower".

But he said changes had been made to the draft plans and promised to boost town centres - rather than out-of-town shopping - and create "garden cities".

Friends of the Earth has warned of "a building free-for-all".

The revised national planning policy framework was published on Tuesday - and will be implemented immediately by councils with no local plan. There will be some transitional arrangements for councils with existing local plans.

The draft version of the new guidelines reduced the existing 1,300-page document to 52 pages, and the final booklet is just 50 pages long.

Among the amendments, it promises to:

  • Help councils which "wish to bring into being a new generation of garden cities"
  • Allow communities to specify where renewable energy sources such as wind farms should, and should not, be located
  • Allow councils to provide the parking in town centres to "help them compete with out-of-town shopping centres and supermarkets"

In a statement to MPs, Mr Clark said that under old "top-down" targets, communities had begun to see planning as something that was "done to them, rather than by them".

Meanwhile, he said, the average age of first-time homebuyers was "approaching 40" and rents were rising - meaning that families were spending more on housing than on their children.

'Keystone'

Mr Clark said he had accepted, in whole or in part, 30 of 35 recommendations made by the Commons Communities and Local Government Select Committee - including a reference to local plans, drawn up by councils, remaining "the keystone of the planning edifice".

And he said a controversial reference to a "presumption in favour of sustainable development" made clear that that should work through, not against, local plans - and should take into account "social and environmental, as well as economic objectives".

The final version made clear that existing policies such as those protecting the Green Belt, sites of special scientific interest, national parks and other areas "cannot be overridden by the presumption", and it would guarantee "robust protections for our natural and historic environment".

It also made "explicit" that councils' policies must encourage brownfield sites to be brought back into use - and allowed them to protect back gardens, while ensuring that "playing fields continued to benefit from the same protection that they do currently".

He said the new framework "will help build the homes the next generation needs, it supports growth to allow employers to create the jobs our constituencies need, it protects what we hold dear, in our matchless countryside and in the fabric of our history".

Critics of last year's draft plans have argued that the "presumption in favour of sustainable development" amounted to a "developer's charter".

The government has been criticised for being too vague about what amounts to "sustainable development" and for saying in the draft plans that the "default answer to development proposals" should be "yes" - unless it compromised "key sustainable development principles".

'Uncertainty and chaos'

Labour's Hilary Benn said the government had made "a mess" of the process, which had done nothing to inspire confidence. Thousands of homes had planning permission but had not been built because of the failure of the government's economic policy, he told MPs.

He welcomed what he called a "U-turn on playing fields and open spaces" but said there should be a national, not local, "brownfield first" policy. He said a planning system should produce homes and jobs but should also protect green spaces, but the new plans "may end up doing neither".

"Far from giving us certainty, there is likely to be delay as developments are held up by appeals and by the courts having to rule on a new and untested approach," Mr Benn said, adding that this would lead to "uncertainty and chaos".

Opponents of last year's draft plan included the National Trust, the Campaign to Protect Rural England (CPRE) and Friends of the Earth.

Ahead of Tuesday's publication, Friends of the Earth campaigns director Craig Bennett said: "A strong planning system is vital for building the clean economy promised by government, but there are mounting concerns that ministers will unleash a building free-for-all that will infuriate local communities and devastate our countryside."

He said the new regulations "must spell out what is meant by 'sustainable development' - to ensure the right buildings are built in the right place and in the best interests of local people and our environment".

The CPRE has also said it feared the planning changes would not deliver enough affordable homes - one of the key benefits supporters say they will provide.

But Simon Nunn, from the National Housing Federation, said the new regulations were a step in the right direction: "I don't think it's going to unleash a development free-for-all.

"There's a housing crisis in the country, we're only building half the homes that we need. Planning is part of the jigsaw and I think that a positive planning framework combined with the right investment framework will help us."

Obama health reform law: clues to how the justices might behave

The four justices who make up the US Supreme Court's liberal wing are expected to uphold the constitutionality of the Obama health reform law. How the other five will see it is less certain.

Predicting US Supreme Court decisions is often compared to reading tea leaves, and is frequently much less accurate. But there are some clues about how the justices may approach their assessment of the constitutionality of the Patient Protection and Affordable Care Act (ACA).

Analysts expect the four members of the court's liberal wing ? Justices Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor, and Elena Kagan ? to vote to uphold the constitutionality of the ACA's individual mandate.

Analysts are less certain about how members of the court's conservative wing might behave.

Some observers have cited Justice Antonin Scalia's concurrence in a 2005 case in California upholding the federal government's power to prosecute the use of medical marijuana even when the drug was home grown and home-consumed legally under a state law.

In upholding the applicability of federal drug laws, the court ? and Justice Scalia ? found that the regulation necessarily reached home use of medical marijuana because such activities might otherwise undermine the comprehensive federal scheme to ban marijuana.

Five years later, in a case called US v. Comstock, the high court again embraced a broad reading of the scope of federal power when it upheld a law that authorized the continued detention of sexual offenders after they had served their criminal sentences.

The law was challenged on grounds that Congress exceeded its constitutional authority in passing the detention law. The justices upheld the law 7 to 2.

In that case, Scalia joined a dissent written by Justice Clarence Thomas denouncing the government's underlying justification for the federal detention law as a pretext to encroach into areas assigned solely to state governments.

The Comstock decision is important because three members of the court's conservative wing joined the majority opinion.

Two of those members, Justice Anthony Kennedy and Justice Samuel Alito, wrote concurrences distancing themselves from the majority opinion's expansive reading of federal authority.

Unlike Justices Kennedy and Alito, the third conservative in that majority opinion ? Chief Justice John Roberts ? offered no written explanation of his view of the case.

Some analysts speculate that Kennedy may be the most likely justice to swing to the liberal side of the court and provide a fifth vote to affirm the ACA.

From his prior decisions, the one justice who seems least likely to vote to uphold the ACA is Justice Thomas.

In the meantime, legal scholars and journalists will be listening closely during oral argument to the tone and character of questions posed by the justices to try to discern revealing hints of which way they may be leaning.

Five Favorite Films with Elizabeth Banks

In our final Hunger Games Five Favorites feature, we present Elizabeth Banks, who plays the vapidly effervescent, Effie Trinket. Trinket is the Reaping Day host for district 12, the one who pulled the names out of the lotto and sent Katniss Everdeen and Peeta Mellark on their way to the Capitol where they, and 22 other tributes, fight to death in the Hunger Games arena. We spoke to Banks for illumination into her movie viewing history.



Giant
(George Stevens, 1956; 97% Tomatometer)

Number one is Giant. Starting off with the incomprable James Dean. I love that movie. I love how epic it is in scope. I love that it's about a woman who is coming into her own and thinks she's going into one situation and, of course, has to dominate and overcome. For me, for my money, if I had to choose between Giant and Gone with the Wind, I'd go Giant every time.

Where would Gone with the Wind place on your list?

It would not place in my top five.

Number two, I'm going to go with Pulp Fiction. It just came out at a really fun time in my life, my early 20s. Maybe even before that; was it '96?

It was 1994.

I think I was graduating from college, yeah. It was just so fresh and amazing, and the storytelling, you know, changed cinema forever. I just loved it. And it brought back John Travolta. Every character was incredible, and I loved its really dark sense of humor. Like, literally some of the hardest laughing I've ever done in my life was when John Travolta accidentally blows the head off that guy. [laughs] Making that funny is such a feat. The comic sensibility of Quentin Tarantino never ceases to amaze me.

The next movie on my list, which is Baz Luhrmann's Romeo + Juliet, starring Leo [DiCaprio] and Claire Danes, that was the movie where I was like, "I want do this for a living." It was one of the few times in my life that I've been truly jealous of a bunch of actors.

That hadn't happened for you until you saw Romeo + Juliet?

Not in the way that really... Like, I saw the movie at a pivotal moment in my life when I was really deciding if I was going to pursue acting, and it was something that I want to be part of, a film like this.

Do you ever think about what your life would be like if you hadn't seen Romeo + Juliet, or if it never came out?

It'd probably be pretty similar; I just wouldn't be so jealous of Claire Danes.

I'm going to go with The Sweet Hereafter. I just love the sort of darkness of that movie, and I just think the performances in that movie... I love Sarah Polley and I always have. That movie, it stayed with me. It stayed with me for a very long time.

Number five, I'm going to go with... I'm picking between the multiple Barbra Streisand musicals of my youth that we would watch on Sundays with my mom. They're all good. Anything with Barbra Streisand.

Would you watch them on television with your mother?

Yeah. I mean, if I had to pick my first R-rated movie that I was like, "This is the greatest movie I've ever seen in my entire life," it was Flashdance. My mom took me to see Flashdance when we were really young. It was like way underage for R-rated; you know, you had to go with an adult. She was the adult who took us, because to my mom, it was just a story about a ballerina.

Was she surprised by the content?

No. I think, actually, she went and saw the movie with her friends and then decided, you know, "It's okay; I can take the girls." She loved it. That whole stripper thing, it kind of went over our heads.


The Hunger Games is playing in theaters now.

Bob Henry, a producer and director of television variety shows including ?The Nat King Cole Show? and ?The Flip Wilson Show,? has died.

According to a recent poll* of more than 10,000 citizens from ten European countries, pollution is the primary concern of the public at large among all issues that threaten the marine environment. A new position paper of the Marine Board-ESF shows that such public concern is not misplaced and is supported by scientific evidence.

About 30,000 of the chemicals currently on the EU market have a production volume higher than one tonne per year. Increasing numbers of these substances end up in rivers, estuaries and seas with potentially damaging effects on marine organisms, ecosystems and processes.

The oceans and seas are of growing strategic importance to Europe, both economically and socially. At the same time, the impact of human activities on marine ecosystems has increased markedly with chemical pollution as one of the main pressures. The latest Marine Board position paper on "Monitoring Chemical Pollution in Europe's Seas: Programmes, Practices and Priorities for research" shows that regulatory frameworks and monitoring programmes do not address the full range of potentially damaging pollutants, and completely overlook many of the 'new' pollutants which have entered use in recent years.

"The level of knowledge and awareness of the presence and potential impacts of new and emerging marine pollutants is still very limited" explains working group co-Chair Patrick Roose from Belgian Management Unit of the North Sea Mathematical Models (MUMM). Co-Chair Colin Janssen from the University of Ghent adds: "To be genuinely effective, monitoring programmes will need to be dynamic and take into account a continually expanding list of chemical pollutants, the impact that different pollutants can have on organisms, ecosystems and processes, and to attribute efforts and resources according to the perceived risk."

Marine Board Position Paper 16, "Monitoring Chemical Pollution in Europe's Seas: Programmes, Practices and Priorities for research", provides an overview of the existing monitoring and assessment frameworks, a critical evaluation of current monitoring practices, and examples of emerging chemicals of concern and mechanisms used to include them in monitoring programmes.

The paper calls for better coordination, cooperation and harmonization between existing monitoring efforts and those under development, to avoid duplication of effort, loss of expertise and a reduced willingness to fulfil the obligations towards regional conventions. It also recommends implementation of state-of-the-art and more integrated environmental risk assessment procedures to evaluate the full impact of chemical substances on the different compartments of coastal and open sea systems.

"Until today, the monitoring of European seas has been largely based on the measurement of chemical concentrations in water, sediments and biota. As such, they are failing to take sufficiently sophisticated approaches to gain insights on the true impacts of chemicals on individuals, populations and whole marine ecosystems" says Kostas Nittis, Marine Board Chair. He concludes: "Until a more scientifically robust and sophisticated approach is adopted, existing monitoring programmes are only providing a part of the picture."

Japan's scandal-hit Olympus to launch new medical devices

TOKYO (Reuters) - Japan's Olympus Corp will unveil new endoscopes on Wednesday, its first major product launch since an accounting fraud erupted last year and threatened the 92-year-old firm's survival.

The medical equipment maker has withstood one of Japan's worst corporate scandals partly because of its profitable endoscope business, which accounts for the bulk of its earnings.

Olympus plans to unveil three new products on Wednesday, five months after the $1.7 billion fraud began to surface, including two video endoscopes for the digestive system. One of the endoscopes is aimed at emerging markets, the company said.

Better known as a camera-maker, the firm long ago used its expertise in optical technology to become a leader in diagnostic endoscopes which are used to peer inside bodies and help diagnose intestinal and stomach cancers and other illnesses.

Olympus controls about 70 percent of the global market for diagnostic endoscopes. Its major rival is fellow Japanese firm Fujifilm Holdings Corp with 10 percent.

"I think this is major," said analyst Nanako Imazu of CLSA Asia Pacific Markets, noting it was unusual for the company to call a two-hour product briefing for media and analysts.

"Every six to maybe seven years they launch new products for flexible endoscopes. At the management level they are still dysfunctional, but at the product level they may want to show that they are pretty strong," she added.

The Olympus board has yet to be fully overhauled despite being discredited by an outside investigation, though all the directors are set to be replaced at an extraordinary meeting next month when shareholders vote on a new line-up.

However, apart from a few top resignations during the course of the scandal, Olympus is being run by many of the same people who sacked the only executive who had internally challenged the firm's bookkeeping, CEO-turned-whistleblower Michael Woodford.

Five of the eight existing internal directors are being sued by Olympus for dereliction of duty.

Woodford meanwhile has failed in his campaign to be reinstated, thwarted by Japanese shareholders, and is suing the company for unfair dismissal. The Englishman is also courting public opinion, with plans to publish a book, ?Terminated', in Japan before the April 20 meeting votes in a new board.

Olympus also plans to unveil an energy-based surgical device on Wednesday. The firm declined to give details ahead of the announcement but these kind of devices can include instruments that both cut and cauterize tissue to stem bleeding.

Most recently, Olympus released an ear, nose and throat endoscope last September, a month before the scandal broke. It had launched an ultrasonic gastrointestinal videoscope in December 2010 and a colon videoscope in August 2010.

The firm's endoscope business has proven to be remarkably resilient because it is a world away from the fickle consumer electronics business, where loyalty counts for little, product cycles are short and hot new fads rule the marketplace.

Endoscopy suites, by contrast, are major investments for customers such as hospitals and specialist clinics whose major concern during the scandal, according to anecdotal evidence, has been continued supply and after-sales service.

CLSA's Imazu said even hospitals turned off by the scandal would have little choice but to continue with Olympus for now.

"Flexible endoscopes is a five-year product cycle so ... they have to use it because they have the infrastructure of their devices installed in their hospitals," she said.

"They have no choice to change supplier right now, that's the reason why their business is pretty strong for flexible endoscopes."

Must See HDTV (March 19th - 25th)

March Madness is in full swing and even if you're not a college hoops fan, that should extend to the rest of the TV schedule this week. After a surprisingly exciting season finale for The Walking Dead AMC is finally ready to bring back Mad Men. Also returning are favorites like Fringe and Mythbusters, although they're balanced out by Archer's third season coming to an end. HBO's Luck also airs its final episode this week and makes the most notorious exit of them all, alongside season finales from The River, Southland and Key & Peele. Look below for the highlights this week, followed after the break by our weekly listing of what to look out for in TV, Blu-ray and videogames.

Battle Royale
This cult favorite is finally getting a US Blu-ray release, offering the tale of Japanese teenagers trapped on an island and forced to fight each other in a game where only one will survive. It's kind of a bizarre story if you're not familiar with it, but well worth watching. Fans can nab either the first flick by itself or a pack including the sequel along with plenty of extras. Mad Men
After the longest of hiatuses, Mad Men is triumphantly returning to AMC. With its cast and director intact we don't expect the sordid tales of advertising execs and those who love them to have lost a step, but true fans have probably had this day marked on the calendar for a while.

Hey, everyone's favorite universe / time shifting sci-fi show is back. We've completely forgotten where Pacey is at this point but as usual, the team of agents and scientists will be investigating some weirdness like they always do.
