Attorney accuses Donald Trump of lying on witness stand

CHICAGO (AP) ? The attorney for an 87-year-old woman who accuses Donald Trump of cheating her in a skyscraper condo deal told Chicago jurors on Wednesday that he was personally repulsed by the "Apprentice" star whom he said lied on the witness stand.

The comments came during a sarcasm-filled closing argument at a trial that pits Jacqueline Goldberg against the billionaire real estate mogul-turned TV showman.

His voice rising, attorney Shelly Kulwin portrayed the case as a battle between a powerful businessman and a woman who learned her values growing up during the Depression.

Trump, of New York, wasn't in court for the closings. But Kulwin projected a photograph of the beaming developer on a large courtroom screen.

"The thought of my grandma being in the same room with that guy. Yuck!" said Kulwin. The judge told jurors to disregard the comment.

Later, he said Trump was motivated to cheat his client by a love for money.

"It's like his family, those dollars," Kulwin said.

Addressing jurors later Wednesday, defense attorney Stephen Novack accused Kulwin of resorting to personal attacks on Trump out of desperation and a lack of evidence.

Goldberg alleges Trump persuaded her to buy two condos at around $1 million apiece in Chicago's glitzy Trump International Hotel & Tower by promising she would share in building profits. But, Goldberg says, Trump reneged after she committed to the investment.

"It's called a bait and switch," Kulwin told jurors. "Here's the bait. Here's the switch."

But Trump's attorney described Goldberg as a detail-oriented investor who knew the contract that she signed stipulated Trump could cancel the profit-sharing offer as he saw fit.

"She knows the drill," he said. "Nobody put a gun to her head (to sign)."

Since the contract gave Trump rights to change the profit-sharing offer, Novack said the onus was on Goldberg's attorneys to prove Trump secretly plotted to defraud her before she even signed up to buy.

"What do they call it? A bait and switch," he said. "Switch is not enough. ... There is no evidence whatsoever of a secret plan."

In two days of sometimes combative testimony last week, Trump denied cheating Goldberg. And he told reporters outside court that he was the victim, not her. He declared, "She's trying to rip me off."

On Wednesday, though, Kulwin said Trump took the stand "to lie, evade and spout infomercials." He also mocked Trump for telling jurors he never took notes of business meetings and so couldn't say for sure when certain decisions were made and by whom.

"People who don't want to be found out don't write things down. They're not stupid," he said. "And Donald Trump may be a lot of things, but he's not stupid."

Kulwin told jurors Goldberg was seeking a total of $6 million in damages.

"Send a message not just to Mr. Trump ? but to tell others like him," he said pounding his hand on a podium. "You can say to them, 'These people who do these things have crossed the line.'"

Agriculture Secretary Vilsack, NFL Quarterback Sam Bradford Urge Native American Youth to Get Active



Washington, April 27, 2011?Agriculture Secretary Tom Vilsack welcomed St. Louis Rams Quarterback Sam Bradford to the Agriculture Department today and joined him in urging Native American youth to spend the summer pursuing healthy outdoor activities. Bradford, an enrolled member of the Cherokee Nation, participated with over 30 Native American students at USDA's People's Garden in planting a Native American garden, called The Roots of American Agriculture.

"Through programs like 'Fuel Up to Play 60' and Let's Move!, the Obama administration is helping get kids active in order to help them have a healthy future," said Vilsack. "Our partners at the NFL and across the country are key to engaging kids in an exciting way that teaches them that physical activity can be fun, while also important to their health."

Bradford and Vilsack noted that a recent study of four year-old children found that obesity is more than twice as common among American Indian/Alaska Native children than among white or Asian children. In 2002, nearly 15 percent of those receiving care from the United States Indian Health Service (IHS) were estimated to have diabetes.

The USDA People's Garden Initiative promotes the establishment of school and community gardens to grow healthy food, people and communities across the country. Over 30 Native students helped plant the garden. Those participating included students representing Eastern and Western tribes, Southeast Alaska, and a class from a Native elementary school in Tuba City, Arizona. The garden showcases heirloom Native American crops and planting techniques and celebrates the tremendous contributions Native Americans have made to the foods we eat today.

Bradford and Vilsack were joined at USDA by Robin Schepper, executive director of First Lady Michelle Obama's Let's Move! Campaign; Keith Moore, the Department of the Interior's Bureau of Indian Education Director, and Janie Hipp, Senior Advisor to Secretary Vilsack with the USDA Office of Tribal Relations.

The First Lady's Let's Move! initiative, which aims to end childhood obesity, has also since joined in support of Fuel Up to Play 60 and USDA's HealthierUS Schools Challenge, which are both helping to combat this issue and provide access to nutrition information.

Fuel Up to Play 60 is an in-school nutrition and physical activity program launched by the National Dairy Council (NDC) and the National Football League (NFL), with additional partnership support from USDA. The program encourages youth to consume nutrient-rich foods (low-fat and fat-free dairy, fruits, vegetables and whole grains) and achieve 60 minutes of physical activity every day. Fuel Up to Play 60 is designed to engage and empower youth to take action for their own health by implementing long-term, positive changes for themselves and their schools.

On April 22, 2010, Bradford was selected by the St. Louis Rams as the first overall pick in the 2010 NFL Draft. He grew up in Oklahoma and spent his college career with the Oklahoma Sooners. In 2008, Bradford became the second sophomore to win a Heisman Trophy. In his first season in the NFL, Bradford won the NFL Offensive Rookie of the Year award after setting the record for most completions by a rookie in NFL history.

In a post two weeks back, the 6 months daily bar chart pattern of gold was analysed with the help of certain technical patterns to explain the descent of gold?s price into a bear market. For a longer-term perspective, let us look at the 2 years weekly bar chart pattern of gold.

Note that the zone between 1500 and 1550 had been providing strong support to gold?s price. Last month, the 1500 level was breached decisively, followed by a high-volume drop (?panic bottom?) below the 200 week EMA. The subsequent pullback moved above the 200 week EMA, but failed to regain the 1500 level.

Gold?s price dropped below the 200 week EMA last week, and looks ready to fall much lower. The 20 week EMA is falling like a stone below the 50 week EMA. Weekly technical indicators are looking bearish and oversold. MACD is falling deeper into negative territory below its signal line. RSI is trying to emerge from its oversold zone. Slow stochastic is sliding down towards its oversold zone.

Bears are using every rise to sell. The time for bottom-fishing hasn?t arrived yet.

Silver Chart Pattern

The 2 years weekly bar chart pattern of silver shows a support zone between 26 and 28 that was decisively breached in Apr ?13. A high-volume ?panic bottom? formed at 22, and after a brief upward bounce, the ?panic bottom? was breached as silver?s price dropped to the target of 20 (mentioned in the previous post).

Silver?s price has spent 6 straight weeks below the 200 week EMA. The 20 week EMA has crossed below the 200 week EMA, and the 50 week EMA may follow soon. A long-term bear market is looming.

Weekly technical indicators are looking bearish and oversold. MACD is falling below its signal line in negative territory, and has entered its oversold zone. Both RSI and Slow stochastic have remained inside their oversold zones for a few weeks.

Looks like ?game over? for the bulls. Any attempt at a rally will probably be an opportunity to sell.

The New Xbox One Is Awesome—But at What Price?

Redmond, Wash.?At Microsoft's Xbox Campus today, the company gave a first look at its next-generation console, the Xbox One, which is coming out later this year (in time for Christmas). Microsoft clearly noticed the drubbing Sony got a few months ago when that company unveiled the PlayStation 4 without showing off any hardware and learned a lesson. Xbox hardware was definitely shown today: a rectangular vented box with glossy black panels accompanied by a new, smaller Kinect that will come standard with the console, and a controller that looks very much like the existing one.

Many of the capabilities of the new Xbox were leaked ahead of time, including the eight-core X86 processor, Blu-ray drive, and new HD Kinect. But it's far more convincing to see it all work in a demo. On stage, Microsoft president of interactive entertainment Don Matrick booted up the Xbox One with an "Xbox On" command. The interface uses the familiar Microsoft Live Tiles, but now integrates a Trending category that combines items that are popular with your friends with those favored by the Xbox community at large. With a command of "Xbox Watch Live TV," Matrick called up "The Price Is Right," then switched to an interactive, voice-controlled TV programming guide called OneGuide that puts every cable box to shame.

This is a new strategy for Microsoft, which for years has been trying to work with cable companies to integrate a tuner into the Xbox. Now the company has obviously abandoned that strategy in favor of an HDMI passthrough with an informational overlay similar to Google TV?though it's worth mentioning that, at first glance, the Xbox UI seems far superior to Google's. That probably means the Xbox One will have no access to your cable box DVR. But the 500 GB on board might allow Xbox to act as its own DVR, a possibility that would undoubtedly unleash an army of lawyers.

Xbox One allows instant switching between games, music, movies, and TV. It even plays live TV within a live tile on the home screen. It also has a Snap Mode similar to Windows 8 that can display additional content next to TV programming. For instance, Xbox has worked out deals with both ESPN and the NFL that will integrate extra angles, real-time commentary, and updates of personalized content such as fantasy leagues while you watch the game. This content can also be pushed to second screens through Microsoft's Smart Glass software that already exists for tablets and smartphones. ?

Snap Mode also can support Xbox One's integrated Skype client, which works with the new 1080p camera in Kinect. Prepare for a new era of divided attention spans as video calls can coexist on your TV screen as you switch back and forth between TV and games. The Kinect accessory has advanced significantly, hardware-wise. Its camera array can handle 1080p at 30 fps and has active infrared sensing and time-of-flight measurement for individual photons. The company claims that the camera tech is sensitive enough to measure a player's heartbeat, which, when you get past the visceral creepiness of the idea, could be enormously useful for exercise games. ?

It took a while during the presentation to get to gaming, but a demo of upcoming EA Sports titles was jaw-dropping. Both EA and Call of Duty developers Infinity Ward have created new game engines that produce super high-fidelity rendering of human movement as well as textures that dwarf the capabilities of the current generation of consoles. In addition to EA Sports franchises, demos today included a preview of the next Forza racing game and a sneak peek of Call of Duty Ghosts (now with a playable special forces dog), which will all launch exclusively on the Xbox One. ?

And that's not the only exclusive content. Microsoft also announced that Xbox will be a platform for original TV content. Xbox Entertainment Studios is teaming up with Steven Spielberg to create a live action series based on the popular Halo franchise. ?

The crowd here was definitely impressed, but there are still are plenty of unanswered questions and a few caveats that could dull the anticipation for the new console. The biggest question is price. If Microsoft can't bring this thing in at under $500, it will be a tough sell as a mass-market consumer device. Also, what about the content that will be allowed to play on the device? Early word had it that the system won't allow play of used games, which are a big market on existing consoles, allowing people to snatch up older games at a discount. Also, from what we can tell, the new console won't play any games designed for the current Xbox, which will severely limit the available content at launch. Finally, it's about time that Microsoft stopped charging for Xbox Live Gold subscriptions, which put much of the online service's best functionality behind a paywall. The company gave no indication that was going to change. ?

If Microsoft nails the pricing on Xbox One, they've got a hit on their hands. At least it seems that way from here.

One year ago this week, The Social nightclub and its joined-at-the-hip restaurant counterpart EVO debuted on E Olive Way. This May, they?re both long gone.

And probably not coming back.

CHS has learned that while one partner of the shuttered club will go up against the Washington State Liquor Control Board next week to make her case in an appeal against the body?s decision not to grant The Social a long-term liquor license, it does not appear the maneuver is related to reopening the club.

According to one of the Social?s partners, much of the dance club?s equipment has been sold and the space is being actively shown to interested parties for a new lease. Prospective tenants range from bars to retail ventures.

The Social?s Laura Olson declined to comment about next week?s appeal session with the board but a person familiar with the situation said it might make sense for the food and drink entrepreneur to clear her slate with the control board so there aren?t future issues with licensing. Most recently, Olson opened Anchors Down, a nautical-themed bar in Ballard.

As for E Olive Way, with the club and bar/restaurant space available, expect to see even more players soon joining Liberty as the most recent arrivals on this busy stretch of Capitol Hill nightlife.

Crazy ants are taking over areas once occupied by fire ants in the South. The sting of Crazy ants isn't as painful and migrate slowly. But Crazy ants multiply faster.

Invasive fire ants have been a thorn in the sides of Southerners for years. But another invasive species, the so-called "crazy" ant ? that many describe as being worse ? has arrived and is displacing fire ants in several places.

"When you talk to folks who live in the invaded areas, they tell you they want their fire ants back," said Edward LeBrun, a researcher at the University of Texas at Austin, in a statement from the school. "Fire ants are in many ways very polite. They live in your yard. They form mounds and stay there, and they only interact with you if you step on their mound."

Crazy ants, on the other hand, "go everywhere," invading homes and nesting in walls and crawlspaces, even damaging electrical equipment by swarming inside appliances. [Image Gallery: Ants of the World]

A study published in the April issue of the journal Biological Invasions found that in areas infested with crazy ants, few to no fire ants were present. Exactly how they are able to outcompete fire ants is so far unknown. In areas with crazy ants, the researchers also found greatly diminished numbers of native ant species, according to the study.

Fire ants are known for their painful stings and have spread through the Southeast since arriving from South America in the 1930s. Crazy ants were first discovered in Houston in 2002, and they have already spread to coastal areas from Texas to Florida, according to the researchers. Although the "crazies" don't have as painful a sting as fire ants, they multiply in even greater numbers. They are also difficult to control since they don't eat the same poison baits as fire ants do, the statement noted.

Last year, the crazy ant species was identified as Nylanderia fulva, which hails from northern Argentina and southern Brazil, according to a 2012 study in PLOS ONE. It's also known as the tawny crazy ant and was previously named the Rasberry crazy ant after the exterminator Tom Rasberry, who first discovered it. The "crazy" moniker comes from the ant's quick, seemingly random movements.

Luckily, the crazy ant doesn't spread as quickly as the fire ant, advancing only 650 feet (200 meters) per year on its own, the release noted. Therefore, it's vital that people don't accidentally transport the ant, the prime method by which it has spread, according to the release.

Conn. derailment to cause 'greatly slowed' commute

HARTFORD, Conn. (AP) ? Railroad officials in Connecticut say the morning commute is going as well as can be expected following Friday's train collision that that injured 72 people and has shut down service.

Metro-North is using a fleet of 120 buses at the Bridgeport train station to help rail commuters make their way around the scene of the accident and help get them get to New York City.

A shuttle train was operating about every 20 minutes Monday morning between New Haven and Bridgeport. Shuttle buses are running between the Bridgeport and Stamford stations, where commuters can then board trains for the final leg of their commute.

Officials say Friday's collision impacts about 30,000 people who normally use the train.

Heavy congestion ? averaging 15 mph ? was reported along Interstate 95 and the Merritt Parkway heading into New York City.

Dior presents cruise fashions amid stars in Monaco

MONACO (AP) ? The glittering star power of Cannes migrated up the coast to Monaco for front-row seats at Dior's colorful, sexy cruise fashion show.

With the Mediterranean Sea the picturesque backdrop, Dior showcased its 2014 collection on Saturday night. It was a wet, cold and generally miserable outside the white stage, but Raf Simons' designs provided the shimmering summery lift for the evening.

Among those on hand were Oscar-winner and Dior spokeswoman Marion Cotillard, actresses Ruth Wilson and Jessica Biel, and Prince Albert of Monaco, along with his fashionable wife, Princess Charlene.

Before the show, Biel called Dior's fashions beautiful, saying she also appreciated them because they were made for real woman. If that was the case, such women are dynamic gazelles who even in their downtime have multiple agendas.

There were sheer lace cover-ups, brightly colored dresses, and jackets and coats made of wool.

In press materials provided at the show, Simons explained his inspiration to prominently feature lace in the collection.

"I never worked with lace before," he said. "It was about transforming the meaning of the material; not romantic, not historical, not old, to something light, playful, colorful and modern ? with energy."

Many of the pieces had an effervescent feel, like the metallic blended with sheer lace and a strip of a coral floral print in one dress; a wool jacket and pants were made vibrant with bright red color.

But there were other outfits that had a more traditional look, like a flowing spaghetti-strap red dress that hit mid-calf at the front but draped near the floor in the back, and the one-piece bathing suits that harkened back to old-style Hollywood glamour ? particularly a brilliant blue piece with ruching in the back.

After an enthusiastic ovation for the show, guests such as Liv Tyler were shuttled to the Oceanographic Museum nearby as Prince Albert and his wife threw a reception that showcased some of the fashions ? including Dior ? worn by his late mother, Princess Grace.

    Flesh-eating disease victim gets prosthetic hands

    ATLANTA (AP) ? A metro Atlanta woman who lost both hands, her left leg and right foot after contracting a flesh-eating disease was on her way back from Ohio Friday after being fitted with prosthetic hands.

    Aimee Copeland, 25, is returning from Hilliard, Ohio, where she was fitted with a pair of "bionic" hands with 24 programmable functions that will improve her dexterity, her father, Andy, told the Associated Press.

    Copeland, of Snellville, contracted a rare infection called necrotizing fasciitis in May 2012 after falling from a zip line and gashing her leg. She spent two months at the Shepherd Center, a rehabilitation clinic in Atlanta, learning to move, eat and bathe without prosthetics.

    She spent part of the week at Touch Bionics being fitted for the prosthetic hands that her father says will be controlled by her muscle movements and arm positions.

    "All four days she sent us videos of things she could do," Copeland said. "The second day she was moving water between cups. On the third day she was cutting a cucumber. On the fourth day she was doing more typical things, like applying makeup to her face and more personal things."

    Copeland said the hands were given to Aimee in exchange for her serving as a Touch Bionics ambassador. He said Aimee is likely to begin looking for a prosthetic leg with a computer-controlled knee joint to allow for more natural movement than a mechanical one.

    "I just really look forward to her regaining her confidence about certain things she's been unable to do," Copeland said, "Really I just want to see her enjoying life the way that she should."

    Among other things, Copeland said, the prosthetic hands will help his daughter learn to prepare meals from scratch, which she enjoyed doing before the amputations.

    Persuasive Speaking Guide Part 4 | Closing the Sale - Ginger Public ...

    It?s that big moment? you?ve stepped in front of an audience and you have a limited time in which to persuade them to think or act differently about your subject. But how do you ?close the sale? in a way that also feels natural? Here?s your persuasive speaking routemap.

    In part one we?ve talked about Authenticity, part two moving From Sleazy Selling to Authentic Allowing, and part three was all about Finding the Right Words. The last in our four part series on persuasive speaking is all about how you close the sale.?

    Let?s start as we mean to go on ? with the attitude of persuasion. Imagine that from the very first word, you are closing the sale. That?s how it is in reality. If you want to influence people, it starts from the beginning of your talk, rather than being something that?s tacked on at the end.persuasive speaker - don't be afraid to fill their heads

    Closing the Sale Step 1: Enrol people to journey with you

    The first words you say have the possibility to open people up to being persuaded by you:

    • What?s credible about you? If you don?t believe in yourself and your message, the audience won?t either. Let them know exactly why they should listen to you and what qualifies you to discuss this topic. Feel your credibility on an inner level. Without going into extensive detail, don?t drone on about all the letters after your name, give them your excitement and your zest for the topic in a way that invites them to really listen to your expertise.?
    • Why would people want to go on the journey with you? Are you a good tour guide, able to interact and tell stories and provide interest along the way? Would YOU like to travel with you? Confidence in yourself will breed confidence within the audience.

    Closing the Sale?Step 2: Tell a story of ?good? and ?evil?

    Next, it?s time to build a journey that takes your audience from their current situation to the brilliant new place you know would benefit them:

    • Build contrasts: Tell a story of the world with your solution versus the world without it. Contrast backwards and forwards between the problem and your solution, raising the stakes as you go. Allow your audience to become engaged and anticipate how YOUR solution will change the world. This is the impression that will allow your audience to truly remember your ideas.
    • Personal stories always work well because? they?re about YOU and your experiences and something that you can speak freely about. The more passionate you are, the more persuasive you?ll be.

    E.g. ?I wanted to be more confident? so I tried something and failed, tried something else and failed, tried for the last time using this particular method and finally succeeded. This is the method I now want to share with you??

    • Be creative and authentic about the persuasive stories you tell, or it will come across as dry and uninviting? or worse yet insincere.

    Closing the Sale?Step 3: Use the right kind of evidence

    If you tell your audience ?This is a really great product / idea? it will have one impact. But when we start to show our audience how great our product or idea is, we leave room for them to be persuaded by our words. Look for a good balance of evidence to support your argument:

    • Just enough logical evidence: A few well placed statistics can be very persuasive as they add legitimacy to your argument. But don?t make the mistake of needing to justify everything you say ? most audience members will switch off from too many ?hard facts?
    • Emotion brings connection: In the end, your audience are human beings just like you, so the most persuasive words will be authentic and emotional. Look to connect your difficulties to the difficulties your audience may face.

    Closing the Sale?Step 4: Powerfully ask for the ?sale?

    The most important aspect of persuasive speaking, that also feels the most difficult is to ?close the sale?. Before you wrap up, make sure that you allow yourself enough time to clearly state what you want your audience to do next.

    This is the ?bungee jump? moment where people have the most fear. But remember ? you have been passionate and authentic. Your audience feel connected to you. By now they like you and your message. What will serve them in this moment is not for you to say ?Thanks very much? and scuttle off the stage. What will serve them is for you to powerfully ask?them to change their behaviours.

    Some key persuasive phrases:

    • I am incredibly passionate about this and I would like to invite you to join.
    • It goes without saying that this topic is important to me and here?s why it should be important for you too?
    • I simply want you to be a part of this.
    • I truly see how this will benefit you.
    • If you want to xyz, then I believe this is the place for you.

    Test these out for yourself and see if you can authentically see yourself saying them. If the answer is ?NO WAY!? then find a way of expressing yourself persuasively that will feel right. Remember, it?s all about your belief in your message and ultimately? you.?

    Closing the Sale Step 5: Stand in your full power

    Once you have asked for the ?sale?, it?s the force of your self belief that will show your audience that you?really mean it. A truly persuasive speaker will stick to their message, even if?nobody else?seems to agree.?

    This is the moment where you get to change the world. And it?s your belief, your confidence and your good intention that will allow that change to happen.

    It?s time to become a warrior

    Stand in your full power to close the sale by:

    • Leaving silence after you?ve made your request. It?s time to stop talking and leave space for the audience to agree with you. Most often it?s too much talk rather than too little that loses the momentum of persuasion.
    • Grounding yourself in your body so that you signal to the audience ?I?m not budging?. If the speaker has a solid presence, (as opposed to a whole load of fidgets in the body), they will be more convincing.
    • Giving permission to break rapport: Sometimes people need to be told a tough truth in order to make a change. Be willing to say something unpopular so that in the long term your audience benefit.
    • Trusting that you?re benefiting: Enjoy this moment, because this is your chance to change someone?s life.

    That?s the final piece of the Persuasive Speaking jigsaw puzzle. Now?s your time to get out there and start speaking persuasively!

    Why Manhattan's Green Roofs Don't Work--and How to Fix Them

    On a rooftop in New York City?s Chelsea neighborhood, two students are collecting soil samples from boxes planted with species from two native plant communities: Hempstead Plains, which are grasses belonging to a prairie community originally found on Long Island, and Rocky Summit grasslands,which grow on the tops of mountains and ridges throughout southern New England and all of New York StateThey carefully place the dirt from the soil core into a plastic bag and seal it up to be taken to the lab for analysis.

    These two students are part of a research team that is trying to figure out how to maximize the benefits of green roofs. The problem has taken on practical significance as grass and other plants sprout on rooftops all over Manhattan and in other cities. For the past two years, New York City Mayor Michael Bloomberg?s PlaNYC initiative has offered tax abatements for green roof construction and grant money for projects to capture storm water. Rooftop gardens have the potential of lowering energy usage for heating and air-conditioning as well as reducing rainwater runoff, but their effectiveness is not well established.

    Researchers are trying to identify the best plant species suitable to green roofs, with an eye to designing ones that fulfill their promise. A 2007 study in the journal BioScience found that green roofs can potentially help manage stormwater runoff, reduce urban heat-island effects and regulate building temperature. To deliver these benefits, rooftop vegetation has to be able to survive the high winds, prolonged UV radiation and unpredictable fluctuations in water availability. To resist these harsh environments, a majority of green roofs are planted with sedum, a non-native species that can survive wind and long periods withoutrainfall. A roof planted with sedum, however, is no greener, from the standpoint of sustainability, than is ordinary tar or asphalt.

    Sedum does not absorb water as efficiently as other plant species, according to Scott MacIvor, a PhD student in biology at York University in Toronto who studies bee and wasp habitats on green roofs there, and co-wrote the city?s new guidelines for biodiverse green roofs. At certain times of the year, he sayssedum actually absorbs heat instead of reflecting it. ?The problem is that sedum plants aren?t really performing on green roofs,? he notes. ?They?re just there.? One of the plant?s biggest failings, it turns out, is that it does not encourage biodiversity of plant species on the roof. According to MacIvor?s research, green roofs provide the most benefit when they are planted with a diverse group of species that are adapted to local conditions.

    Krista McGuire has taken sedum?s inadequacy as a challenge. The assistant professor of biological sciences at Barnard College wanted to see if a variety of native plants could survive on green roofs and how well they would deliver the desired benefits. Since 2010, the year Bloomberg announced his green roof initiative, McGuire has been comparing soil samples from 10 roofs planted with native vegetation with soil from five city parks spanning New York?s five boroughs, seeking to identify the microbial communities that thrive on green roofs to better to understand how healthy rooftop ecosystems sustain themselves.

    Her study, published in PLoS ONE last April, found that green roofs have distinct fungal communities that help plants to thrive in harsh, polluted environments and filter heavy metals. On average, 109 different types of fungi were present on each roof including Pseudallescheria fimeti, a fungus that grows in polluted soils and human-dominated environments. Rooftop soil also contained fungi from the genusPeyronellaea, which live in the tissues of plants to help them take in nutrients.

    McGuire hopes her research will be able to help inform green roof companies on planting the best species for each rooftop. Three of the rooftops, which received more intensive sampling, showed that fungal communities are different from one roof to another. Roofs are microclimates, McGuire says. Fungal growth depends on the position of the roof, pollution levels in the area, temperature and how much rainfall it receives. ?Plant species are adapting to new environments,? she says. ?Without the fungi, the plants would not be able to grow and survive.?

    ?In the long term, this information may help individuals decide which types of soil microbes to amend on their green roofs, so that they can maximize plant survival and minimize management,? she says.

    In late 1942, less than a year after Pearl Harbor, the U.S. government began snapping up property in eastern Tennessee. Within a matter of months, approximately 59,000 acres of farms and orchards, homesteads and hovels just south of the Black Oak Ridge hosted immense construction sites that became the home of supersecret facilities used to enrich uranium for the Manhattan Project. Kiernan chronicles the fascinating lives of some of the young women who lived and worked in this fenced-in town, helping to develop the first atomic bombs.

    At its wartime peak, the largely self-contained Oak Ridge community housed about 75,000 people but used more electricity than New York City.

    It employed a diverse workforce that included janitors, administrators, chemists and statisticians, many of them female because men were off at war. But unlike Rosie the Riveter, who could actually see the items she helped manufacture rolling off the assembly lines, few if any of the women of Oak Ridge knew how they were helping the war effort. To preserve that secrecy, recruiters hired many of these women fresh out of high school ? mostly because, at the time, young ladies in the workplace were expected to do what they were told and not to ask a lot of questions.

    Brief chapters provide vital context into the technical aspects of uranium enrichment, as well as the progress taking place at other Manhattan Project sites. But the most interesting parts of this history deal with the social aspects of life in a bustling community so rife with secrecy that the local paper didn?t print the names of residents in its articles.

    (AP) ? The ousted head of the Internal Revenue Service apologized to Congress on Friday for his agency's tougher treatment of tea party and other conservative groups seeking tax-exempt status. He said they resulted from a misguided effort to handle a flood of applications, not political bias.

    "I want to apologize on behalf of the Internal Revenue Service for the mistakes that we made and the poor service we provided," Steven Miller, who has been acting IRS commissioner, told the House Ways and Means Committee as the panel held Congress' first hearing on the episode. "The affected organizations and the American public deserve better. Partisanship and even the perception of partisanship have no place at the Internal Revenue Service."

    At a hearing that saw lawmakers from both parties harshly criticize his agency, Miller conceded that "foolish mistakes were made" by IRS officials trying to handle a flood of groups seeking tax-exempt status. He said the process that resulted in conservatives being targeted, "while intolerable, was a mistake and not an act of partisanship."

    Though Miller and another top IRS official are stepping down, the chairman of the committee said that would not be enough.

    "The reality is this is not a personnel problem. This is a problem of the IRS being too large, too powerful, too intrusive and too abusive of honest, hardworking taxpayers," said Rep. Dave Camp, R-Mich.

    Camp also said the tougher examinations that conservative groups encountered seemed to be part of a "culture of cover-ups and intimidation in this administration." He offered no other examples.

    Camp's remark about cover-ups drew a sharp retort from the committee's top Democrat, Rep. Sander Levin of Michigan. Levin said if the hearing became a preview of the 2014 political campaigns, "we'll be making a very, very serious mistake."

    The administration has been forced on the defensive about last September's terrorist attack in Benghazi, Libya, that killed the U.S. ambassador and three other Americans, and the government's seizure of The Associated Press' telephone records as part of a leaks investigation.

    Republicans are hoping to link the issues in an effort to raise questions about President Barack Obama's credibility and make it harder for him to press a second-term agenda.

    Friday's hearing is the first of what are expected to be many on the subject by congressional panels. Underscoring the seriousness of the episode, Miller was sworn in as a witness, an unusual step for the Ways and Means panel and one that could put Miller in jeopardy if he is later shown to have misled lawmakers with his testimony.

    Levin said that the IRS's mistreatment of conservative groups meant the agency "completely failed the American people." He said Lois Lerner, who heads the IRS division that makes decisions about tax-exempt groups, should be "relieved of her duties."

    Miller said the IRS struggled to efficiently handle growing numbers of applications for tax-exempt status.

    The agency has said between 2008 and 2012, the number of groups applying for tax-exempt status as so-called social welfare groups more than doubled. Along with that was an increase in complaints that such groups were largely engaging in electoral politics, which is not supposed to be their primary activity.

    "I do not believe partisanship motivated the people" at the IRS who engaged in the harsher screening for conservative groups, Miller said.

    In recent months, Republicans on the Ways and Means panel had repeatedly asked the IRS about complaints from conservative groups that their applications were being treated unfairly.

    On Friday, numerous Republicans wanted to know why Miller and others never told them the groups were being targeted, even after May 2012, when the IRS has said Miller was briefed on the practice. Miller was previously a deputy commissioner whose portfolio included the unit that made decisions about tax-exempt status.

    "I did not mislead Congress or the American people," Miller told Rep. Charles Boustany Jr., R-La., one of several Republicans who challenged him about why he hadn't mentioned the targeting in the past.

    Also testifying Friday was J. Russell George, the Treasury Department's inspector general for tax administration.

    In a report he issued this week, George said IRS officials reported they were not politically pressured to target conservative groups. Asked about that conclusion, George said Friday, "We have no evidence at this time to contradict that assertion," but in prepared testimony to the committee he said he is continuing to investigate that question.

    George's report concluded that the IRS office in Cincinnati, which screened applications for the tax exemptions, improperly singled out tea party and other conservative groups for tougher treatment. The report says the practice began in March 2010 and lasted more than 18 months.

    The report blamed "ineffective management" for letting IRS officials craft "inappropriate criteria" to review applications from tea party and other conservative groups, based on their names or political views. It found that the IRS took no action on many of the conservative groups' applications for tax-exempt status for long periods of time, hindering their fundraising for the 2010 and 2012 elections.

    Republicans have spent the past few days trying to link the IRS' improper scrutiny of conservatives to Obama. The president has said he didn't know about the targeting until last Friday, when Lerner acknowledged at a legal conference that conservative groups had been singled out.

    Many of the groups were applying for tax-exempt status as social welfare organizations, which are allowed to participate in campaign activity if that is not their primary activity. The IRS judges whether that imprecise standard is met.

    Attorney General Eric Holder has said the FBI was investigating whether the IRS may have violated applicants' civil rights.

    Obama has rejected the idea of naming a special prosecutor to investigate the episode, saying the investigations by Congress and the Justice Department were sufficient.

    Obama has named Daniel Werfel, a top White House budget officer, to replace Miller.

    Also Thursday, Joseph Grant, one of Miller's top deputies, announced plans to retire June 3, according to an internal IRS memo. Grant is commissioner of the agency's tax exempt and government entities division, which includes the agents that targeted tea party groups for additional scrutiny.

    Grant joined the IRS in 2005 and took over as acting commissioner of the tax exempt and government entities division in December 2010. He was just named the permanent commissioner May 8.

    When asked whether Grant was pressured to leave, IRS spokeswoman Michelle Eldridge said Grant had more than 31 years of federal service and it was his personal decision to leave.

    Wall Street slips after Fed comments, but Cisco surges

    NEW YORK (Reuters) - Stocks fell on Thursday, with the downturn accelerating late in the day after a Federal Reserve official said the central bank could begin easing up on its monetary stimulus this summer.

    The three major U.S. stock indexes had earlier traded in a tight range, supported by a gain of more than 12 percent in Cisco Systems shares and as investors took in a batch of economic data that pointed to slower growth.

    But the S&P 500 finished near its session low following the comments from John Williams, the president of the Federal Reserve Bank of San Francisco, who also said the Fed could end its bond purchases later this year, assuming the labor market continues to grow stronger.[ID:nN9E8KD02P] Williams is not a voter on the Fed's policy-setting panel this year.

    "When a Fed governor is out there and mentions this possibility, it does spook the market a little because I don't think anybody quite knows how the stock market is going to react once (the stimulus) is taken away," said Tim Ghriskey, chief investment officer of Solaris Group in Bedford Hills, New York.

    The Fed's purchases of $85 billion a month in bonds has been a significant driver of the rally in equities that has taken indexes to record highs and pushed the S&P 500 up nearly 16 percent this year.

    Analysts also said the comments could have been viewed as a reason to take a pause after such a strong run-up in stocks.

    "It turned a boring day into a bit of profit taking," Ghriskey said.

    Other Fed officials on Thursday called for the central bank to stop buying mortgage-backed bonds, citing improvement in the housing market.

    The Dow Jones industrial average <.dji> dropped 42.47 points, or 0.28 percent, to close at 15,233.22. The Standard & Poor's 500 Index <.spx> fell 8.31 points, or 0.50 percent, to end at 1,650.47. The Nasdaq Composite Index <.ixic> slipped 6.37 points, or 0.18 percent, to finish at 3,465.24.

    Earlier, the Dow reached an all-time intraday high at 15,302.49.

    The Nasdaq fared better than the other two major indexes as Cisco shot up 12.6 percent to $23.89 after the network equipment maker posted a higher-than-expected quarterly profit and said current-quarter revenue could increase.

    Dell , in the midst of a takeover battle between activist investor Carl Icahn and its billionaire founder, reported a steep drop in quarterly profit after the closing bell as personal computer sales continued to shrink. The stock slipped 0.5 percent to $13.37 in after-hours trade. [ID:nL2N0DX272] During the regular session, Dell's stock dipped 0.2 percent to end at $13.43.

    In other news after the close, J.C. Penney reported that operating margins plunged in the first quarter while total sales and same-store sales registered double-digit declines - in line with its warning last week. The stock vacillated between gains and losses, and was most recently down 1 percent at $18.60. [ID:nL2N0DX2AP] The company has gone back to basics with marketing and promotions aimed at winning back customers, who left in droves under the failed strategy of former Chief Executive Ron Johnson.

    Early in the day, economic data set a lackluster tone in markets as data from the Philadelphia Federal Reserve showed factory activity in the mid-Atlantic region contracted, while the Commerce Department reported that U.S. housing starts plummeted 16.5 percent in April. New claims for jobless benefits unexpectedly jumped last week.

    However, investors had speculated that soft underlying inflation also means the Fed has room to continue its economic stimulus.

    Wal-Mart Stores Inc fell 1.7 percent to $78.50 and dragged on the Dow after the world's largest retailer posted a quarterly profit that missed expectations, with sales down 1.4 percent at U.S. stores open at least a year.

    Tesla Motors Inc shares gained 8.7 percent to $92.25 after the electric carmaker said it aims to raise $830 million through a stock-and-debt offering that will be used to repay its U.S. Department of Energy loans with interest. The stock has surged more than 50 percent since the company reported earnings last week.

    Volume was roughly 6.45 billion shares on the New York Stock Exchange, the Nasdaq and the NYSE MKT, compared with the year-to-date average daily closing volume of about 6.34 billion.

    Decliners outnumbered advancers on the NYSE by a ratio of 3 to 2, while on the Nasdaq, 14 stocks fell for nearly every 11 that rose.

    Former NBA union head files suit against Fisher

    Ousted NBA players' association executive director Billy Hunter alleges in a lawsuit that president Derek Fisher had a secret deal with owners during the 2011 lockout that benefited himself, his publicist and certain players.

    Hunter contends that Fisher undermined Hunter's efforts to make an agreement and interfered with his position by secretly negotiating with select owners in violation of union bylaws.

    Filed Thursday in California Superior Court, the suit seeks unspecified damages for defamation and breach of contract. It also names the National Basketball Players Association and Jamie Wior, Fisher's publicist, and says Fisher and Wior worked after the lockout ended "to terminate his employment without cause and in violation of his contract."

    "Wior harbored aspirations to assume a position of responsibility with the NBPA," the suit says. "She set out to craft a new public persona for Fisher, taking control of his media appearances and public statements and encouraging him to overreach his authority."

    Hunter was ousted in February following an investigation into his business practices that found no illegal conduct but cited several conflicts of interest, questionable business decisions and hiring practices. Fisher finished the season with the Oklahoma City Thunder.

    "It's unfortunate that I must take this action against an organization where I had the privilege of working with many dedicated associates over 17 years," Hunter said in a statement. "I'm proud of our record of achievement on behalf of players during my tenure as Executive Director and will continue to stand up for their interests. But I cannot let stand attacks on my character or accept what has been done."

    The suit says owners were aided by Fisher when they locked out players in July 2011 after the expiration of the last collective bargaining agreement. It says the veteran guard realized he could have been on his last contract as a player, so he wanted to secure a "soft landing" after his career by keeping good relations with the league and team owners, even while Hunter was committed to a firm stance.

    "Unbeknownst to Hunter, however, Fisher was secretly negotiating with the Certain Owners ? on his own and without any authority ? to settle the negotiations on terms less favorable to the players," the suit says.

    "The NBPA's Constitution and By-Laws vest in Hunter the sole right to conduct collective bargaining negotiations on behalf of the Union. Fisher's interference in the negotiations exceeded his authority and undermined the Union's negotiating power. Wior's interference was completely without authority or basis. Ultimately, the players accepted a new CBA that left them with a greatly reduced share of the NBA's revenues."

    The lockout ended in November 2011 with players' receiving a 50-50 split of basketball-related income, after they were guaranteed 57 percent in the previous deal. The relationship between Hunter and Fisher at times seemed strained, with Fisher often speaking to reporters alone after bargaining sessions while Hunter left quickly.

    Fisher said he had just learned of the lawsuit before meeting with reporters in Oklahoma City and didn't want to comment.

    "Obviously in any type of legal situation, you have to be very careful about what you say. So, I guess at the appropriate time I'll be able to respond or make a statement," he said.

    Wior and a union official didn't immediately return messages.

    Hunter led the union since 1996 before he was voted out during the All-Star break with more than $10.5 million left on his contract.

    Sci-fi fans are generally fairly mild-mannered folk. But don't get them angry. You wouldn't like them when they're angry. Unfortunately, there was lots of anger in Norwich, UK, over the weekend, when fans of "Doctor Who" and "Star Wars" squared off outside a convention -- and yes, "the force" was called. The police force.

    According to Norwich Evening News 24, it all started at the 4th Norwich Sci-Fi and Film Convention on Sunday, which was hosted by the Norwich "Star Wars" Club UK and Hollywood Cinemas. The convention refused entry to members of the Norwich Sci-Fi Club by the members of the Norwich "Star Wars" Club, reportedly after the treasurer of the Sci-Fi Club asked a "Doctor Who" actor for an autograph.

    Sci-Fi Club treasurer Jim Poole was asked to leave after requesting the autograph, and he and organizer Richard Walker reportedly had words inside before taking it outdoors.

    It's unclear why this was a flashpoint -- Walker later told Evening News 24 that the visitors had been trying to undermine the convention with Facebook comments -- but it led to over a dozen fans (many dressed in costume) facing off outside the venue.

    There were no light saber and sonic screwdriver duels, but police did respond to a report that a man was being assaulted. After investigating and reviewing closed-circuit footage, police determined no assault had taken place. A spokesperson told the News that "the two rival groups were spoken to and advised to keep out of each other's way."

    Despite the incident, Walker called the event "a very successful day."

    At least no one had to go to the dark side.
